Public offer agreement
In accordance with the current Ukrainian legislation, trading through an online store is distance selling. In this regard, the online resource of the snabhim.com.ua store is the Chempostachannya trading platform. The contractual relationship between the buyer and the seller of the Chempostachannya Company is drawn up in the form of a public offer agreement.
Pressing the "Confirm" button in the Internet resource on the page placing an order means that the buyer, regardless of status (individual, legal entity, individual entrepreneur), in accordance with the current Ukrainian legislation, has accepted the terms of the public offer agreement, which are indicated below.
The public offer agreement is public, i.e. in accordance with Article 633 of the Civil Code of Ukraine, its conditions are the same for all buyers, regardless of status (individual, legal entity, individual entrepreneur). In full agreement with this Agreement, the buyer accepts the conditions and procedure for placing an order, payment for goods, delivery of goods, liability for an unfair order and for failure to comply with the terms of this agreement.
The contract is considered concluded from the moment you click the "Confirm" button on the order placement page and confirm its purchase. If necessary, at the request of the buyer, the contract can be drawn up in a simple written form.
Essential terms of the public offer agreement:
1. Conditional agreements
1.1 Conditional agreements are the definitions present in this agreement, which are its integral part.
1.2 Definitions are interpreted based on their essence and the content of this agreement. The following is a list of these definitions:
• snabhim.com.ua - Marketplace, online store.
• Goods - an object of agreement between the parties, which is selected by the buyer in the online store snabhim.com.ua and placed in the basket of the online store snabhim.com.ua
• Buyer - any capable individual, legal entity, individual entrepreneur, in accordance with the current Ukrainian legislation, who visited the site snabhim.com.ua, who intends to purchase the Goods and pay for the receipt of such Goods.
• Seller — Company "Himpostachannya" the owner of the goods offered on the site of the online store snabhim.com.ua, represented by Poltaratsky Ruslan Nikolaevich
2. General provisions
2.1 This public offer (hereinafter referred to as the contract) defines the features of the purchase and sale of goods on the website snabhim.com.ua.
This offer applies to any product offered for sale (purchase) on the snabhim.com.ua website.
3. Subject of the public offer agreement.
3.1 Providing the Buyer with access to all necessary information on the Goods (confirming the quality and safety of its use) provided within the framework of the snabhim.com.ua project.
4. The moment of conclusion of the contract.
4.1 The text of this Agreement is a public offer and is valid for all visitors of the snabhim.com.ua online store who have the intention, desire and ability to purchase goods.
4.2 Acceptance of the offer - the purchase of goods in the manner determined by this agreement, at the prices indicated on the snabhim.com.ua Internet resource and acceptance of the terms of payment and delivery of the goods.
4.3 The fact of purchasing the Goods is the unconditional acceptance by the Buyer of the terms of this Agreement. The Buyer who used the services of snabhim.com.ua is considered as a person who has entered into a contractual relationship with the Seller.
5. Rights and obligations of the parties.
5.1 snabhim.com.ua undertakes to transfer the goods to the Buyer:
• in a certain place
• in a certain amount
• in the appropriate completeness and in the kit, if any
• good quality
• free from third party claims
5.1.1 From the moment of conclusion of this Agreement, ensure in full all obligations to the Buyer in accordance with the terms and conditions stipulated jointly by the site snabhim.com.ua and this agreement. The company "Himpostachannya" reserves the right to default in case of force majeure situations.
5.1.2 Do not disclose any private information about the Buyer and do not provide access to this information to third parties, except as required by law or at the request of the Buyer.
5.2 snabhim.com.ua has the right:
5.2.1 Change the terms of this Agreement, as well as Tariffs (prices) for Goods and Services, unilaterally by placing them on the server at snabhim.com.ua.
5.2.1.1 All changes are effective immediately upon posting.
5.2.2 Refuse to provide services without explanation.
5.2.3 Send promotional and informative letters to customers.
5.3 The Buyer undertakes:
5.3.1 Before the conclusion of the Agreement, familiarize yourself with the content of the Agreement, the terms of the Agreement and the tariffs (prices) offered by the Seller on all pages of the site snabhim.com.ua.
5.3.2 In fulfillment by the Seller of its obligations to the Buyer, the latter must provide all the necessary data that uniquely identify him as the Buyer and sufficient to deliver the Goods he paid for to the Buyer.
6. Disclaimer of Warranties.
6.1 The Seller makes every effort to provide quality services to the Buyer. Advice and information given to the Buyer cannot be considered as a guarantee.
6.2 The Parties are released from liability for non-fulfillment or improper fulfillment of obligations under the Agreement for the duration of the "force majeure". "Force majeure" means extraordinary and insurmountable circumstances under the given conditions that prevent the parties from fulfilling their obligations under this Agreement. These include natural phenomena (earthquakes, floods, etc.), circumstances of public life (military operations, states of emergency, major strikes, epidemics, etc.), prohibitive measures of state bodies. During this time, the parties do not have mutual claims, and each of the parties assumes the risk of the consequences of force majeure.
7. Delivery of goods.
7.1. The Buyer receives the Goods by delivery, or receives it personally. The order of payment and receipt is specified in the section "Delivery and payment"
7.2. When delivering goods to other cities of Ukraine, the Buyer fully and unconditionally agrees with the Rules for the carriage of goods, which are available on the website of the Carrier Company.
7.3. The fact of receipt of the goods and the absence of claims to the quality of the goods, the Buyer confirms with his own signature in the invoice upon receipt of the goods. For its part, the Chempostachannya Company guarantees the shipment of the goods to the Carrier Company in the quantity agreed and paid by the Buyer, complete according to the specification of this product and in proper (working) condition and quality.
7.4 In the absence of the Buyer at the delivery address specified by the Buyer in the application or the Buyer refuses due to a reason different from the specified p.p. 6.2 from receipt of the goods upon delivery by the courier of the Carrier Company, the goods are returned to the shipping mall. Payment for the services of the Carrier Company is charged from the amount transferred by the Buyer for the goods of the Chempostachannya Company. The balance of the amount is returned to the Buyer on the basis of his letter sent to info@snabhim.com.ua indicating the current account to which the funds should be returned.
7.5. In case of damage or damage to the goods during the delivery of the Company, Chempostachannya returns the cost of the order to the Buyer within 14 working days from the receipt of the "act of damage to the goods", the form of which is provided by the Carrier Company, signed by the Buyer.
8. Other terms.
8.1. Information about the Goods is presented on the main site.
8.2. All disputes and disagreements arising from the fulfillment by the parties of their obligations under this Agreement shall be resolved through negotiations. If it is impossible to eliminate them, the parties have the right to apply for judicial protection of their interests.
